The Purpose of this Notice

This Talent Privacy Notice describes how eBay Inc., its subsidiaries, affiliates, and joint ventures (collectively referred to as “eBay”, the “Company” or “We”) handle your personal data or personal information (“Personal Data”) collected via our career placement websites and services (the “Site”). 

We may amend this Talent Privacy Notice at any time by posting a revised version on our Site. The revised version will be effective at the time we post it.

By using this Site, you expressly consent to our collection, storage, use, transfer, and disclosure of your Personal Data, including any sensitive information you elect to submit. By providing Personal Data via this Site, you expressly consent to the terms of this Talent Privacy Notice.

Controller

The exact eBay entity responsible for the collection and processing of your personal data in connection with your application depends on (a) the job opening(s) you are applying to; and (b) the eBay entity to which the job opening ultimately relates.

What Information We Collect and How We Collect It

When you visit the Site, we collect information sent to us by your computer, mobile phone, or other access device. The information sent to us includes data on the pages you access on the Site, your computer IP address, device identifiers, the type of operating system you’re using, your location, mobile network information, standard web log data, and other information. Web log data includes the browser type you’re using and traffic to and from our site. 

If you submit an application, you will be required to submit Personal Data, otherwise you may not be able to access certain parts of the Site and we will not be able to process your application. This information includes:

  • Identifying information, such as your first and last name, alias, postal address, email address, social security number, driver's license number, passport number, your date of birth or other similar identifiers.
  • Professional or employment-related information, including education history, work history, certifications, and any other information provided in your CV, resume, and transcripts; your right to work documentation; references; any information provided during your interview or application; or background check information when permitted by applicable law, such as the results of the background check in connection with your employment with us, like your criminal records and credit history.
  • Special category data, such as information relating to your ethnicity/racial origin/sexual orientation, philosophical beliefs, trade union membership, health, and biometric information. We collect this information as permitted by the law and will use this to conduct equal opportunity and diversity monitoring where permitted or required by law.
  • eBay user ID


We may also obtain information about you from third parties such as employment research firms, identity verification services, and websites on the Internet.

​​​​​​​If you fail to provide information when requested, which is necessary for us to consider your application (such as evidence of qualifications or work history), we will not be able to process your application successfully. For example, if we require a credit check or references for this role and you fail to provide us with relevant details, we will not be able to take your application further.

How We Use Your Information and the Appropriate Legal Basis for Processing

Our primary purpose in collecting Personal Data is to provide you with a smooth and efficient experience in applying for a job with us. More broadly, we collect the categories of Personal Data listed above for human resources, employment, benefit administration, health and safety, and business-related purposes and to comply with applicable laws and regulations. 

It is in eBay’s legitimate interest to decide whether to appoint you to a role. eBay also needs to process your Personal Data to decide whether to enter into a contract of employment with you. In certain cases, we may be required to process your Personal Data to comply with our legal obligations, or to protect your vital interests or the vital interests of another natural person.

Your submitted application and any additional Personal Data will be used to:

  • Open and maintain your records, communicate with you for internal business purposes or emergencies, maintain an internal directory.
  • Evaluate you in connection with your selected job opening and/or for available positions. 
  • Evaluate and verify your experience and qualifications in relation to specific job requirements.
  • Determine your eligibility to work and fulfill our obligations to relevant government authorities.
  • Contact you regarding your application and possible employment opportunities.
  • Conduct lawful background screening.
  • Make decisions about who to offer employment.
  • Make decisions about salary and other benefits.
  • Carry out our human resources functions and activities. 
  • Measure activities and maintain functionality of this Site.
  • To comply with our legal obligations, including:
    • carrying out checks in relation to your right to work; 
    • equal opportunities monitoring; 
    • determining reasonable adjustments;
    • make reasonable adjustments for disabled employees; 
    • to allow us to carry out our legitimate business interests, such as business planning and restructuring exercises, except where such interests are overridden by your interests in not having your Personal Data processed; and 
    • to comply with various state and local mandates as to the COVID-19 pandemic. 
  • Conduct equal opportunity and diversity monitoring where permitted or required by law, and to comply with legal obligations.
  • To protect the vital interests of you or a third party.

Disclosure

We take care to allow your Personal Data to be accessed only by those who require access to perform their tasks and duties, and to share it only with third parties who have a legitimate purpose for accessing it. The Company does not sell or transmit your Personal Data for cross-context behavioral advertising. We will only share your Personal Data in the following circumstances:

  • With eBay affiliates and subsidiaries, and eBay Employees. Your Personal Data will be shared with eBay employees where it is necessary for them to undertake their duties with respect to your potential employment, such as to interview you, and with the other eBay entities as may be necessary to administer our relationship with you or operate our business.

  • With Service Providers and Other Third Parties. We may share your Personal Data with our contractors, vendors, and service providers that assist us with administering the employment or working relationship with you and/or provide services to us or on our behalf. For example, service providers may include, but are not limited to, IT administrators, marketing/events agencies, recruitment agencies, and credit and criminal background check providers. Other third parties may include those who provide professional services (such as attorneys, auditors, accountants, management consultants, and medical service providers), professional bodies, and regulatory authorities in the normal course of business.

  • Legal or Regulatory Requests and Investigations. We may disclose your Personal Data to third parties under the following circumstances (i) to comply with relevant laws or regulations, to respond to a court order, administrative or judicial process, such as a subpoena, warrant, court order, or government audit; (ii) in response to lawful requests by public authorities (such as national security or law enforcement); and (iii) as necessary to establish, exercise or defend against potential, threatened or actual litigation (such as adverse parties in litigation). We may also need to share Personal Data with tax authorities, courts, regulators, the police, and other governmental authorities where we are required or permitted to do so by law in jurisdictions in which we operate.


The Company will not sell, rent, or otherwise disclose your Personal Data to third parties for their marketing purpose or for cross-context behavioral advertising without your explicit consent.

Cookies

When you access our Site, we (including companies we work with) may place small data files on your computer or other device. These data files may be traditional cookies, pixel tags, "Flash cookies," or other local storage provided by your browser or associated applications ("Cookies"). We use these technologies to: recognize you as an applicant, customize our services, measure the Site’s effectiveness, help ensure that your account security is not compromised, mitigate risk and prevent fraud, and to promote trust and safety across our sites.

We use both session and persistent Cookies. Session Cookies expire and no longer have any effect when you log out of your account or close your browser. Persistent Cookies remain on your device until you erase them or they expire.

How we Protect and Store Personal Information

Throughout this Privacy Notice, we use the term “Personal Data” to describe information that can be associated with a specific person and can be used to identify that person. We do not consider Personal Data to include information that has been made anonymous so that it does not identify a specific user.

We protect your information using physical, technical, and administrative security measures to reduce the risks of loss, misuse, unauthorized access, disclosure, and alteration. Some of the safeguards we use are firewalls and data encryption, physical access controls to our data centers, and information access authorization controls.

Accessing or Changing Your Personal Information

Subject to possible restrictions under national law, as a data subject, you have the right to access, rectification, erasure, restriction of processing, and data portability with regard to your personal data. In addition, you can object to our processing of your personal data on the basis of our legitimate interests. You can also lodge a complaint with a supervisory authority. 

You can access, review, and change most of your Personal Data by logging into the Site. You must promptly update your Personal Data if it changes or is inaccurate. 

You may make formal requests via the Data Privacy eRequest Tool or by contacting us by email. Upon your request, we will deactivate or remove your Personal Data from our active databases, although some information may be retained as permitted or required by law.

Retention

We may delete your Personal Data at any time (including your CV/resume) as permitted or required by law.

We retain your Personal Data for as long as necessary in accordance with legal obligations as well as for purposes outlined within this Talent Privacy Notice.

Binding Corporate Rules

The transmission of personal data between different eBay Inc. corporate family members (e.g. to enable cross border transactions and for other legally permitted purposes) is based on our worldwide data protection principles, which are binding internal data protection regulations (“Binding Corporate Rules”, “BCRs”), or on the basis of other appropriate safeguards (e.g. standard data protection clauses issued or approved by the European Commission (2021/914/EU, 2010/87/EU, 2001/497/EC or 2004/915/EC)).

Through our Binding Corporate Rules, the eBay Inc. corporate family members undertake to protect your personal data and to comply with data protection obligations. eBay Nondisclosure Form

In anticipation of a potential visit to eBay in connection with the job application process, we are asking you to agree to this Nondisclosure Agreement. Throughout your visit you may see or hear information important to eBay’s business and considered confidential. This agreement defines what we consider to be confidential information and steps you should take in keeping our confidence. Further, in connection with your visit, which may include receipt of certain confidential and proprietary information of eBay and/or one or more of its subsidiaries (collectively, “eBay”), you agree to the following:

"Confidential Information" shall mean all information disclosed by eBay to you that eBay deems confidential, and may include but shall not be limited to information related to the intended or actual design, construction, maintenance or operation of any real property owned or occupied by eBay and proprietary technical and business information, including but not limited to: (a) patent and patent applications; (b)techniques, sketches, drawings, works of authorship, models, inventions, processes, equipment, algorithms, software programs, software source comments, and formulae related to current, future and/or proposed products and services of eBay, including information concerning research, development, design details and specifications; and (c) information in tangible or intangible form relating to and/ or including any of the following: released or unreleased products, the marketing or promotion of any products, business policies of practices, financial information, procurement and/or purchasing requirements, customers (former, current, or potential), investors, employees, business and contractual relationships, business forecasts, sales and merchandising data, and marketing plans.

All Confidential Information, regardless of the medium (including photos, videos or other physical or electronic media, and copies thereof) shall remain eBay’s property and shall not be removed from the premises or disclosed to any third party without eBay’s prior written consent executed and acknowledged by an authorized eBay representative. Except as expressly set forth herein, no rights or licenses to any eBay intellectual property rights are implied or granted under this agreement.

You acknowledge that monetary damages may not be a sufficient remedy for unauthorized use or disclosure of Confidential Information and that eBay shall be entitled, without waiving any other rights or remedies, to such injunctive or equitable relief as may be deemed proper by a court of competent jurisdiction, without obligation to post any bond.

This agreement shall be governed by the laws of the State of California, excluding its conflicts of laws principles. Any disputes under this agreement shall be brought in the state courts and the Federal courts located in San Jose, California and you hereby consent to the personal jurisdiction and venue of these courts. This agreement constitutes the entire agreement and supersedes all prior or contemporaneous oral or written agreements, regarding the subject matter hereof. Any addition or modification to the agreement, or waiver of a provision hereof, must be in writing and signed by both parties. If any provision of this agreement is held unenforceable, that provision shall be severed and the remainder of this agreement will continue in full force and effect.

This section provides additional information only pertaining for job applicants or candidates (referred further as “Applicants”), who are California residents, under the California Consumer Privacy Act of 2018, as amended by California Privacy Rights Act of 2020 (“California Privacy Law”). Personal information is typically data that identifies an individual or relates to an identifiable individual. This includes information you provide to us, information which is collected about you automatically, and information we obtain from third parties.

eBay does not knowingly collect, disclose, share, or sell the personal information of Applicants under the age of 16. According to our practices we do not hire anyone under the age 18. If you are a parent or guardian and become aware that your child has provided us with personal information, please contact us and we will work with you to address the issue. 

Personal Information We Collect

We may collect certain personal information about you when you browse this Site, submit a job application to one of our open positions, or when we consider you for employment. Listed below are the categories of personal information that we may process about you.

  • Identifiers, such as your first and last name, alias, postal address, email address, social security number, driver’s license number, passport number or other similar identifiers. 

  • Other identifying information, such as physical characteristics or description, date of birth or signature.

  • Inferences drawn from any of the information listed above, such as applicant profile or preferences, characteristics, attitudes, intelligence, abilities, and aptitudes.

  • Other identifying information, such as physical characteristics or description, date of birth, or signature.

  • Internet or other electronic network activity information, such as information relating to how you have used this Site. 

  • Characteristics of protected classifications under California or federal law, such as age, race, color, national origin, citizenship, religion, marital status, medical condition, physical or mental disability, sex (including gender, gender identity, gender expression, pregnancy or childbirth and related medical conditions), sexual orientation, veteran or military status to the extent voluntarily disclosed by Applicants.

  • Sensitive personal information, such as your social security and Other IDs, financial account and log in information, precise geolocation, information about ethnic/citizenship/racial origin/sexual orientation, philosophical beliefs, or union membership, email and messages contents, and biometric information. We collect this information to determine your eligibility to work and fulfill our obligations to relevant government authorities, to pay you or provide other benefits and process any expense claims, and for security and fraud prevention purposes, as permitted by the law. We will use this to conduct equal opportunity and diversity monitoring where permitted or required by law.


We collect much of the personal information described above directly from you through application forms, resumes, or CVs you submit to us, as well as official documentations you provide to us. We also collect certain information from third parties, such as employment agencies (such as recruiters and headhunters), and former employers when gathering references, and service providers that collect it on our behalf, such as communications providers, scheduling providers and IT providers. We may collect personal information about you through background check, credit reference agencies and government entities where permitted or required by law. Finally, we may also gather information from your public social media profile to complement the personal information you have provided.

Sharing Your Personal Information

  • Protection of the Company or Others. We may share your personal information where necessary to protect eBay, including to investigate, prevent, or take action regarding possible illegal activities, suspected fraud, safety of person or property, or a violation of our policies.

  • Disclosures with Your Consent. We may collect, use and disclose your personal information for other purposes not listed in this privacy notice. If we do so, we will make it known to you at the time we collect, use or disclose your personal data, and, where required, obtain your consent for doing so.


The Company does not sell Applicant’s personal information or sensitive personal information, and it does not transmit it for cross-context behavioral advertising.  

Data Retention

For each of the categories of information described above, your personal information will be stored by us and our service providers in accordance with applicable data protection laws to the extent necessary for the processing purposes set out in this Talent Privacy Notice. Except as otherwise permitted or required by applicable law or regulation, we endeavor to retain your personal information only for as long as necessary to fulfil the purposes for which it was collected, as required by law or to satisfy any legal or reporting obligations, or as necessary to resolve disputes. 

To determine the appropriate retention period for personal information, we consider applicable legal requirements, the amount, nature, and sensitivity of the personal information, the potential risk of harm from unauthorized use or disclosure of your personal information, and the purposes for which we process your personal information. When the data retention period expires, we will delete your personal information in accordance with our data retention and deletion policy or take steps to properly render the data anonymous, unless we are legally obligated or permitted to keep your personal information longer (e.g., for legal compliance, tax, accounting, or auditing purposes).

Your Rights in Relation to Your Personal Information 

As a California resident, subject to certain exceptions, you may be able to assert certain rights related to your personal information as identified below. Please note that California Law permits us to deny your request: (a) when denial of the request is required or authorized by law; (b) when granting the request would have a negative impact on another's privacy; (c) to protect our rights and properties; (d) where the request is frivolous, excessively burdensome, vexatious, or for other lawful reasons. If we deny your request, we will explain the reasons in our response. 

For eBay to fulfill your request, you must provide sufficient information for us to reasonably verify that you are the Applicant from whom we collected the personal information. The information you send for us to verify your identity will be used for this purpose only. If we are unable to verify your identity or if we suspect fraudulent activity, we may decline to comply with your request. 

Right to Access (also called a “Request to Know”). California Applicants have the right to request that we disclose the personal information that we collect, use, disclose, and sell. This includes the right to request the categories of personal information we have collected about them, the categories of sources of personal information, the business or commercial purpose for collecting or selling personal information, the categories of third parties with whom we share or sell personal information, and the specific pieces of personal information we have collected.

Right to Deletion. Subject to some exceptions, California Applicants have the right to request the deletion of the personal information we have collected from them. 

Right to Correction. Subject to some exceptions, as a California Applicant you have the right to request the correction of inaccurate personal information.

Right to Limit the Use of Sensitive Personal Information. To the extent your sensitive personal information (as that term is defined under California Privacy Law) is used to infer characteristics about you, you have the right to direct us to stop such processing of your sensitive personal information for such purposes. Unless permitted to do so under the applicable law, we do not process any sensitive personal information to infer characteristics about you outside of the uses authorized by subdivision CPRA Section 1798.121(a). 

Right to Opt Out of Sale. You have the right to opt-out of the sale of your personal information. Pursuant to California Privacy Law, a “Sale” is the transfer of personal information to third parties in exchange for money or other valuable consideration. In the preceding 12 months, the Company did not sell your personal information to third parties.

Right to Opt Out of Targeted Advertising. You may have the right to opt-out of the sharing of your personal information to third parties for cross-contextual behavioral advertising purposes. In the preceding 12 months, the Company did not share Applicants’ personal information with third parties for cross-contextual behavioral advertising purposes. 

How to Exercise Your Rights

To exercise your rights to access (“know”), deletion, correction/rectification, portability, Applicants can make a rights request at any time through the Data Privacy eRequest Tool. You may click here to create a secure account and submit your request. 

  • Go to the Data Privacy eRequest Tool and securely log in.
  • Under New Request, Request Type, Select the respective Right – e.g., Access, Deletion, Rectification, Other Privacy Request.
  • Under “You are a” select as applicable: “Candidate”, “Applicant”, “Third Party”, etc. 
  • We try to fulfill requests within 45 days of receiving the request. If we need more time or additional information to fulfill your request, we will write to let you know.
  • For those who have difficulties or would prefer to submit a request outside of Data Privacy eRequest Tool, you may submit your request via email
  • Identity Verification. eBay is required to verify the identity of everyone to whom we provide personal information. Please include your first name, last name, state and country of residence, and the email address you used. Before fulfilling your data request, we’ll ask you for Proof Of Identity (POI) and Proof Of Address (POA) to ensure that we are only releasing personal information to authorized parties.


Authorized Agents Exercise of Privacy Rights. If you are submitting a request on behalf of an Applicant you may submit the request via the dedicated Applicant portal at: https://privacyrequest.corp.ebay.com/, and in the field “You are a” select “Third Party” or by email and note that “I am a third party making a request on behalf of a data subject”. You will need to provide POI and POA for the Applicant on whose behalf you are submitting the request and proof that you are authorized to act on their behalf. Only after verifying both your authorization to act and proof of the requestor’s identity will we fulfill the request. Please note that the report containing a copy of the requestor’s personal information will be sent directly to the email on file of the Applicant, if one was provided. If the name, address, or email address you provide us for the requestor does not match what is in our records, we will not be able to process the request.

Right Against Discrimination. A business may not discriminate against a California Applicant for exercising any of the rights described in this section. We will not discriminate against you for exercising your rights. eBay does not use the fact that you have exercised, or requested to exercise, any of these rights for any purpose other than facilitating a response to your request.
